Fisheries and Oceans Canada (DFO) is seeking feedback regarding potential amendments to the Marine Mammal Regulations, including long-term planning for the Southern Resident Killer Whale (SRKW) protection and recovery.
Boaters are encouraged to participate in the survey HERE to have your voice heard to help the planning process. When using the online form, you won’t need to sign up for an account or provide any personal information. You can also provide feedback by email via the website. Per the Government of Canada, “a summary of recommendations and comments will be made available publicly via a What We Heard report that will be posted on the DFO and Consulting with Canadians websites.” Engagements are being sought with First Nations and Indigenous Groups, Stakeholders, and the General Public.
The comment survey period is currently open and available through September 3rd, 2024. Input is being sought covering the following topics:
- Amendments for approach distances to Pacific killer whales
- Administrative issues such as outdated references to Indigenous peoples and geographic locations
- Terminology to clarify “aircraft” to include drones, or remotely piloted aircraft systems
- Potential change from “Disturbance Authorization” to “Disturbance Licence” to align with other legislation
Current Regulations for Canada/BC Waters:
- Boats must remain 400 metres from killer whales in the SRKW avoidance waters between Campbell River and just north of Ucluelet until May 31, 2025, per the Interim Order of the Canada Shipping Act.
- Boats must stay 200 metres from all killer whales (outside the noted avoidance waters).
- Boats must stay 200 metres from all whales and marine mammals that are resting
- Boats must stay 100 metres from whales, other than killer whales, and other marine mammals
- Boats are prohibited from entering two Sanctuary Zones located in the Gulf Islands from June 1 to Nov. 30
